How do I know if I have a lemon?
Under the California Lemon Law (Song-Beverly Consumer Warranty Act), manufacturers are granted a reasonable number of repair attempts to fix a substantial defect before a vehicle is deemed a 'lemon.' A substantial defect is one that impairs the vehicle’s use, value, or safety and is not caused by owner abuse. Recent 2025 updates (AB 1755) now require specific pre-litigation notices to expedite buybacks. We are a California-licensed firm dedicated to protecting your rights under these new regulations.
Does it cost anything to hire a Lawyers?
Under California’s Song-Beverly Act, if you prevail in a Lemon Law claim, the manufacturer is required to pay your reasonable attorney's fees and costs. We represent clients on a contingency basis, meaning you pay no attorney's fees out of pocket. Clients are not responsible for costs advanced by the firm if no recovery is obtained.
What if my car is out of warranty?
Even if your vehicle is currently out of warranty, you may still have a claim if the defect occurred and was reported to an authorized dealer while the express warranty was still active. However, under the 2025 Lemon Law reforms (AB 1755), you must generally file your claim within one year of your warranty's expiration and no later than six years from the date the vehicle was first delivered.
Can my car qualify as a lemon if I bought it used?
Yes, California’s Lemon Law applies to used vehicles purchased from a retailer (dealership), provided they are sold with a manufacturer’s warranty or a Certified Pre-Owned (CPO) warranty. Private party sales (i.e from a friend or family member) do not qualify.
If the car was bought outside CA, does lemon law still apply?
The California Lemon Law generally applies only to vehicles purchased or leased within California. However, there is a significant exception: Active-duty members of the Armed Forces stationed in or residing in California are protected even if their vehicle was purchased out-of-state. For other out-of-state purchases, you may still qualify for compensation under the Federal Magnuson-Moss Warranty Act.
